The United States govt has launched an attraction versus a UK court’s decision to refuse to extradite Wikileaks founder Julian Assange.

Australian citizen Assange, who is aged 50, was indicted by the US Office of Justice in 2019 around his alleged involvement in the acquisition and publication of 1000’s of categorised US diplomatic and navy paperwork.

The Trump administration sought Assange’s extradition to the US, the place he faces 17 rates under the Espionage Act and 1 demand underneath the Laptop Fraud and Abuse Act. 

In Westminster Magistrate’s courtroom in January, District Judge Vanessa Baraitser blocked Assange’s extradition on mental overall health grounds. 

Baraitser built her judgement immediately after hearing from Assange’s law firm that the Wikileaks founder’s risk of suicide would be “imminent the minute extradition gets probable.”

In July, Britain’s Substantial Court granted the United States government permission to lodge an appeal versus Baraitser’s January ruling. 

Now, the Biden administration has commenced a legal attraction to get Assange extradited to the United States and is arguing that before assessments of Assange’s mental overall health had been mistaken.

James Lewis QC, representing the US, instructed the Lord Chief Justice and Lord Justice Holroyde now that Judge Baraitser had been misled by Assange’s psychiatrist, Professor Michael Kopelman. 

Lewis said that Kopelman concealed Assange’s connection with his fiancé, Stella Morris, and the existence of their two young children – things that may well dissuade Assange from ending his lifestyle.

Lewis also stated that the US had not been provided an prospect to remedy the fears for Assange’s protection that had been expressed by Baraitser.

Lawyers acting on behalf of the United States gave four binding assurances about the procedure of Assange. 

These included assurances that Assange would get “any scientific and psychological remedy” that prison medical professionals recommended, and that the US would approve Assange’s application to provide a sentence in his indigenous Australia. 

The United States also gave the insurance coverage that it would not make Assange serve a custodial sentence in the United States Penitentiary, Administrative Utmost Facility (USP Florence ADMAX).
